Terms of Service

These Terms of Service (these "Terms") set forth the conditions for using the service "megurii" (the "Service") provided by Kohei Matsushima (the "Operator," "we," or "us"). All users who use the Service shall be deemed to have agreed to these Terms.

Article 1 (Application)

1. These Terms apply to all relationships concerning the use of the Service.
2. Individual guidelines posted by us on the Service (such as the Community Guidelines) constitute a part of these Terms.

Article 2 (Registration)

1. A prospective registrant shall agree to these Terms and apply for registration by the method prescribed by us.
2. We may refuse registration in the following cases:

• The applicant is under 13 years of age
• The applicant has previously been suspended for violating these Terms
• The applicant has provided false information
• Any other case we deem inappropriate

Article 3 (Account)

1. Users are responsible for strictly managing their own account information.
2. Transferring or lending an account to a third party is prohibited.
3. Acts performed through an account shall be deemed acts of that user.

Article 4 (Rights to Posted Content)

1. The copyright in content posted by a user to the Service (photos, text, location information, etc.; "Posted Content") belongs to the user.
2. The user grants us the following non-exclusive, royalty-free, sublicensable license to use the Posted Content:

• Reproduction, public transmission, translation, and editing to the extent necessary to provide, improve, and promote the Service
• Display to other users (subject to the visibility settings)
• Use for the purpose of introducing or promoting the Service

1. Where Posted Content includes the rights of a third party (copyright, portrait rights, trademark rights, etc.), the user is responsible for obtaining the necessary permissions.

Article 5 (Prohibited Conduct)

In using the Service, users must not engage in the following acts. For details, please also refer to the Community Guidelines.

• Acts that violate laws and regulations or public order and morals
• Acts related to criminal activity
• Acts that infringe the copyright, portrait rights, trademark rights, privacy rights, or honor of a third party
• Unlawful intrusion onto private property or posting photos taken in locations where photography is prohibited
• Stealth marketing or tie-up posts without PR disclosure
• Interference with business or defamation
• Posting obscene, violent, or discriminatory content
• Impersonating us or a third party
• Spam, automated posting, or unauthorized access
• Acts that interfere with the operation of the Service
• Acts we deem inappropriate

Article 6 (Removal of Posts / Suspension of Use)

1. If we determine that a user's post violates these Terms or the Community Guidelines, we may make the post private or delete it without prior notice.
2. A post may be automatically made private upon the accumulation of reports (for example, three or more).
3. For serious or repeated violators, we may suspend or delete the account.

Article 7 (Subscription)

1. The Service offers a paid subscription, "megurii Pro."
2. For details on fees, payment methods, cancellation methods, etc., please refer to the Notice Based on the Act on Specified Commercial Transactions.
3. Subscriptions renew automatically. Cancellation can be made through the cancellation flow within the Service.
4. Even after cancellation, the Service remains available until the next renewal date. No pro-rated refunds will be made.

Article 8 (Advertising / Affiliates)

1. The Service contains advertisements and affiliate links.
2. Transactions conducted after navigating from an affiliate link to an external site are contracts between that external site and the user, and we bear no responsibility for them.

Article 9 (Location Information / Privacy)

1. The Service uses EXIF information and location information from photos. For details, please refer to the Privacy Policy.
2. Users may delete or edit location information before posting. Users are responsible for taking care to avoid identifying their home, workplace, etc.

Article 10 (AI Features)

1. The Service may provide AI-based itinerary synthesis and translation features (some of which are paid).
2. The accuracy and safety of AI-generated output are not guaranteed. Users must exercise their own judgment when using such features.
3. We bear no responsibility for any damage arising from the use of AI features.

Article 11 (Integration with External Services)

The Service integrates with external services such as Google Maps and Apple Sign-in. The terms of service of each respective service apply to the use of these external services.

Article 12 (Disclaimer)

1. We do not guarantee the accuracy, usefulness, or fitness for a particular purpose of the contents of the Service.
2. We bear no responsibility for disputes between users or with third parties arising from Posted Content.
3. Except in cases of our willful misconduct or gross negligence, we bear no responsibility for any damage arising from the use of the Service.
4. Even where we bear responsibility, the cap on damages shall be the total amount of subscription fees paid by the relevant user to us during the preceding one year.

Article 13 (Change, Suspension, or Termination of the Service)

We may change the contents of the Service, or suspend or terminate its provision, without prior notice to users.

Article 14 (Amendment of these Terms)

1. We may amend these Terms.
2. In the event of a material change, we will notify users within the Service or by email.
3. If a user uses the Service after a change, the user shall be deemed to have agreed to the amended Terms.

Article 15 (Governing Law / Jurisdiction)

1. These Terms shall be governed by the laws of Japan.
2. Disputes concerning the Service shall first be addressed through good-faith consultation between the parties.
3. If a dispute cannot be resolved through consultation, the Tokyo District Court shall be the court of exclusive agreed jurisdiction for the first instance.
